Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of FortisVPN, including our applications, website, VPN infrastructure, subscriptions, features, software, and related services (collectively, the "Services").
FortisVPN is operated by EACT Technologies OÜ, a private limited company incorporated in Estonia under registry code 17570948, with its registered address at Tornimäe tn 5, Kesklinna linnaosa, Tallinn, Harju maakond, 10145, Estonia ("EACT Technologies OÜ", "FortisVPN", "we", "us", or "our").
By creating an account, purchasing a subscription, downloading or installing our software, or accessing or using the Services, you agree to these Terms.
If you do not agree to these Terms, you must not use the Services.
1. Eligibility
You may use FortisVPN only if you are legally capable of entering into a binding agreement under the laws applicable to you.
If you are below the age at which you may independently enter into such an agreement, you may use the Services only with the authorization of a parent or legal guardian where permitted by applicable law.
You may not use FortisVPN if your use of the Services is prohibited by applicable law.
2. The FortisVPN Service
FortisVPN provides virtual private network and related privacy, security, connectivity, and software services.
Depending on your subscription, device, platform, geographic location, and the version of the Services available to you, features may include:
- encrypted VPN connections;
- access to VPN server locations;
- IP address substitution;
- dedicated IP functionality;
- split tunnelling;
- tracker blocking;
- advertising blocking;
- privacy and security features;
- applications for supported devices and platforms; and
- other features introduced by FortisVPN.
The availability and functionality of individual features may vary between operating systems, devices, subscription plans, countries, and application versions.
We may improve, modify, replace, add, or discontinue individual features as the Services develop, subject to applicable consumer law.
3. Accounts
Certain Services require a FortisVPN account.
You agree to provide accurate information when creating or maintaining your account and to keep information reasonably necessary for account administration up to date.
You are responsible for maintaining the confidentiality and security of your account credentials.
You must not knowingly permit unauthorized persons to access your account.
If you believe your account has been compromised or accessed without authorization, you should contact FortisVPN promptly.
You are responsible for activity occurring through your account to the extent permitted by applicable law.
4. Subscriptions
FortisVPN may offer free and paid Services, including subscriptions of different durations or feature levels.
The price, billing period, included features, and other material subscription information will be presented to you before purchase.
A paid subscription provides a limited, personal, revocable, non-exclusive, non-transferable right to use the applicable FortisVPN Services during the subscription period, subject to these Terms.
Purchasing a subscription does not transfer ownership of FortisVPN software, infrastructure, intellectual property, or technology to you.
5. Automatic Renewal
Where a subscription is offered on an automatically renewing basis, this will be disclosed during the purchase process.
Unless cancelled before the applicable renewal date, an automatically renewing subscription may renew for the period disclosed at purchase, and the applicable payment method may be charged the then-applicable subscription price.
You may cancel automatic renewal using the method available through the platform or payment channel through which the subscription was purchased.
Cancellation of automatic renewal normally prevents future renewal charges but does not automatically terminate access for the subscription period already paid for.
Mandatory cancellation and renewal rights under applicable consumer law remain unaffected.
6. Purchases Through Application Stores and Third Parties
FortisVPN subscriptions may be available through third-party platforms such as application stores, marketplaces, resellers, or other payment providers.
When you purchase through a third party, certain aspects of the transaction may also be governed by that provider's terms, billing rules, cancellation procedures, and refund processes.
Where a third-party platform controls billing or refunds, you may need to manage your subscription or request a refund directly through that platform.
These Terms continue to govern your use of the FortisVPN Services unless the applicable third-party terms require otherwise.
7. Free Trials and Promotional Offers
FortisVPN may offer free trials, introductory pricing, discounts, promotional subscriptions, coupons, or other offers.
Eligibility, duration, pricing, renewal conditions, and other applicable restrictions may vary by offer and will be communicated with the offer.
Unless otherwise stated, promotional offers may be limited to eligible users, may not be combined with other offers, may be modified or withdrawn before acceptance, and may be subject to reasonable anti-abuse restrictions.
If a free trial automatically converts to a paid subscription, this will be disclosed before you begin the trial where required by applicable law.
8. Prices, Taxes and Payments
Prices are displayed in the applicable currency before purchase.
Depending on your location and payment method, prices may include or be subject to VAT, sales tax, GST, or other applicable taxes.
You authorize the applicable payment provider to charge amounts properly due for subscriptions or purchases you initiate.
FortisVPN may change subscription prices from time to time.
Price changes will not retroactively alter amounts already paid for a completed subscription period. Where required by law, appropriate notice will be provided before a price change affects a renewing subscription.
9. Refunds and Money-Back Guarantee
Eligible FortisVPN purchases may be covered by our advertised 30-day money-back guarantee.
The eligibility requirements, exclusions, procedures, and other conditions governing refunds are described in our Refund Policy, which forms part of these Terms.
Purchases made through certain application stores, marketplaces, resellers, or third-party payment channels may be subject to the refund procedures and decisions of the applicable provider.
Nothing in these Terms or the Refund Policy limits any mandatory refund, withdrawal, cancellation, or consumer rights available under applicable law.
10. License to Use FortisVPN Software
Subject to these Terms and your applicable subscription, EACT Technologies OÜ grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use FortisVPN software on supported devices for lawful personal or authorized business use.
Except where applicable law expressly permits otherwise, you may not copy or redistribute FortisVPN software except as expressly authorized; sell, rent, lease, sublicense, or commercially redistribute the software; reverse engineer, decompile, disassemble, or attempt to derive source code from the software; circumvent technical restrictions or licensing controls; modify the software to create an unauthorized derivative product; remove proprietary notices; or use FortisVPN intellectual property in a manner not authorized by us.
Nothing in these Terms restricts rights that cannot lawfully be excluded.
11. Device Usage
A FortisVPN subscription may permit use on multiple supported devices.
The number of devices or simultaneous connections permitted may depend on the applicable subscription plan and technical limitations communicated by FortisVPN.
You may use FortisVPN on devices that you own or are authorized to control.
FortisVPN may implement reasonable technical measures to prevent excessive simultaneous connections, automated account sharing, credential resale, or other abuse of subscription limits.
12. Acceptable Use
You agree to use FortisVPN lawfully and responsibly.
You may not use the Services to violate applicable laws or regulations; distribute malware, ransomware, viruses, or other malicious software; conduct unauthorized access, intrusion, exploitation, or attacks against computers, networks, accounts, or services; conduct denial-of-service or similar disruptive attacks; engage in phishing, credential theft, identity theft, or fraud; distribute unlawful content; exploit or harm children; engage in human trafficking or other serious criminal activity; send unlawful spam or conduct abusive automated messaging; interfere with the integrity, security, or operation of FortisVPN infrastructure; attempt to obtain unauthorized access to FortisVPN systems; intentionally consume disproportionate infrastructure resources in a manner that materially degrades the Services for other users; resell or commercially redistribute FortisVPN access without our authorization; or use the Services for any purpose prohibited by applicable law.
The fact that FortisVPN provides privacy technology does not authorize unlawful conduct.
13. Copyright and Intellectual Property Infringement
You may not use FortisVPN to infringe intellectual property rights in violation of applicable law.
FortisVPN does not control the content users independently access or transmit over the internet.
We may respond to legally valid intellectual-property notices and take action concerning accounts or Services where required by applicable law.
Nothing in these Terms constitutes authorization to access, reproduce, distribute, or otherwise use copyrighted material without the necessary rights or permissions.
14. Abuse of the Service
We may take reasonable measures to protect FortisVPN, our infrastructure, users, and third parties from fraud, attacks, abuse, or material violations of these Terms.
Depending on the circumstances, such measures may include limiting abusive activity, restricting particular functionality, temporarily suspending an account, terminating an account, or taking other proportionate technical or legal action.
Where reasonably practicable and appropriate, we may provide notice before or after taking action.
We are not required to provide advance notice where immediate action is reasonably necessary for security, fraud prevention, legal compliance, or protection of the Services.
15. No-Logs and Privacy
FortisVPN is designed to protect users' privacy.
Our collection and processing of personal information is governed by the FortisVPN Privacy Policy.
As described in that Policy, FortisVPN does not maintain logs identifying users' VPN browsing histories, websites visited, DNS requests, or the content of traffic transmitted through the VPN.
The technical routing of network traffic necessary to operate a VPN connection does not mean that FortisVPN creates or retains a browsing history.
You should review our Privacy Policy for complete information regarding our privacy practices.
16. Advertising and Promotional Content
FortisVPN may display advertisements, sponsored content, promotional messages, recommendations, or offers within its applications or Services.
Such content may relate to products or services offered by EACT Technologies OÜ or selected third parties.
Advertisements displayed within FortisVPN do not give advertisers access to the content of your VPN traffic.
FortisVPN does not use websites visited, browsing history, DNS queries, VPN traffic content, or internet destinations accessed through the VPN to personalize advertisements.
Additional information regarding advertising and privacy is provided in our Privacy Policy.
FortisVPN does not guarantee or endorse an independent third-party product merely because an advertisement or offer for that product appears within the Services.
Transactions entered into directly between you and an independent third-party advertiser or merchant are generally between you and that third party.
17. Third-Party Websites and Services
The Services may contain links to or interact with third-party websites, applications, platforms, payment services, advertisements, or other services.
Third-party services are independently operated and may be subject to separate terms and privacy policies.
FortisVPN is not responsible for the availability, content, security, policies, or practices of independent third-party services except to the extent responsibility cannot lawfully be excluded.
18. Dedicated IP Services
FortisVPN may offer dedicated IP addresses or similar optional services.
A dedicated IP may, by its nature, be assigned to a particular account or subscription and therefore may have different privacy and technical characteristics from shared VPN infrastructure.
Users choosing a dedicated IP acknowledge that repeated use of the same IP address may make activity associated with that IP more readily linkable by websites or third parties than activity using rotating or shared VPN addresses.
The availability, location, replacement, and technical characteristics of dedicated IP addresses may vary.
19. Tracker Blocking and Ad Blocking
FortisVPN may provide features designed to block or reduce certain advertisements, trackers, malicious domains, or similar network requests.
No blocking technology can identify or block every advertisement, tracker, malicious domain, or unwanted resource.
Accordingly, FortisVPN does not guarantee that these features will block every advertisement, block every tracker, identify every malicious resource, prevent all forms of tracking, or operate identically on every website, application, device, or platform.
Some websites or services may function differently when blocking features are enabled.
20. VPN Limitations
A VPN can improve privacy and security, but it does not make a user completely anonymous or eliminate every online risk.
FortisVPN does not guarantee that use of the Services will provide complete anonymity; prevent all tracking; prevent malware or phishing; prevent all data breaches; make insecure websites secure; protect information voluntarily provided to websites or services; prevent websites from identifying users through account logins or other methods; or make unlawful activity lawful.
Users remain responsible for appropriate security practices and for their conduct online.
21. Geographic and Third-Party Restrictions
Some websites, streaming services, applications, networks, governments, or other third parties may restrict VPN usage or access from particular IP addresses or locations.
FortisVPN does not control those restrictions.
We therefore do not guarantee uninterrupted access to any particular third-party website, streaming platform, application, game, content library, financial service, or online service.
Availability may change without notice due to decisions made by third parties outside FortisVPN's control.
22. Service Availability
We aim to provide reliable Services, but VPN and internet services depend on numerous systems and networks that may occasionally become unavailable or degraded.
The Services may be interrupted by maintenance, server failures, network congestion, internet service provider issues, infrastructure failures, cyberattacks, software updates, third-party outages, governmental or network restrictions, or events outside our reasonable control.
We do not guarantee that every server, location, protocol, feature, or application will be continuously available.
Where reasonably possible, we will work to restore affected Services.
23. Speed and Performance
VPN performance may vary substantially depending on factors outside FortisVPN's control.
These may include your physical location, selected VPN server, distance from the server, internet service provider, network congestion, device performance, operating system, VPN protocol, local network conditions, and third-party network infrastructure.
Any descriptions of FortisVPN as fast, high-speed, or similar are general descriptions of the intended service and do not constitute a guarantee of a particular connection speed, latency, or bandwidth.
24. Updates
FortisVPN may release software updates, patches, security updates, feature changes, or new versions.
Certain updates may be necessary to maintain compatibility, security, or functionality.
You are responsible for keeping your applications reasonably current.
Older versions may eventually become unsupported where necessary for security, compatibility, or operational reasons.
25. Intellectual Property
FortisVPN software, applications, website content, designs, graphics, interfaces, technology, trademarks, logos, documentation, and other proprietary materials are owned by EACT Technologies OÜ or their respective licensors, except where otherwise indicated.
These Terms do not transfer any intellectual-property ownership to you.
You may not use FortisVPN branding, trademarks, logos, or other proprietary materials in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization.
26. Feedback
If you voluntarily provide suggestions, ideas, feature requests, or other feedback concerning FortisVPN, you permit us to use that feedback to improve or develop our products and Services without an obligation to compensate you.
This does not transfer ownership of your unrelated intellectual property or personal content to FortisVPN.
27. Suspension and Termination by FortisVPN
We may suspend or terminate access to the Services where reasonably necessary because of a material violation of these Terms; fraudulent activity; unlawful use; serious or repeated abuse; attacks against our infrastructure; unauthorized resale; non-payment; security threats; legal requirements; or conduct that materially harms FortisVPN, its users, infrastructure, or third parties.
Where appropriate and reasonably practicable, we may provide an opportunity to remedy a violation before termination.
Immediate suspension or termination may occur where reasonably necessary because of serious abuse, security threats, fraud, or legal obligations.
Termination for a material violation of these Terms may affect eligibility for discretionary refunds, subject always to mandatory consumer rights and the applicable Refund Policy.
28. Termination by You
You may stop using FortisVPN at any time.
You may also cancel automatic renewal through the applicable account, payment provider, or application-store mechanism.
Stopping use of the Services or deleting an application from your device does not necessarily cancel an automatically renewing subscription.
You are responsible for using the applicable cancellation mechanism where required.
Account deletion and subscription cancellation are separate processes unless expressly stated otherwise.
29. Discontinuation of the Services
We may modify or discontinue all or part of the Services for legitimate business, technical, security, or legal reasons.
If we permanently discontinue a material paid Service before the end of a prepaid subscription period, we will provide an appropriate remedy where required by applicable law, which may include continued access, replacement service, account credit, or a proportionate refund.
30. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
We do not warrant that the Services will always be uninterrupted, error-free, completely secure, or compatible with every device, network, website, or third-party service.
We do not guarantee access to any particular website, streaming service, online platform, geographic content library, or third-party service.
Nothing in these Terms excludes warranties, guarantees, or consumer protections that cannot lawfully be excluded or limited.
31. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the maximum extent permitted by applicable law, EACT Technologies OÜ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, business opportunities, goodwill, or data, arising from or relating to the Services.
To the maximum extent permitted by applicable law, our aggregate liability arising from or relating to the paid Services will not exceed the greater of the amount you paid to FortisVPN for the applicable Services during the 12 months immediately preceding the event giving rise to the claim, or any minimum amount of liability required by applicable law.
These limitations do not apply to liability that cannot legally be limited, including where applicable liability arising from fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
32. Your Responsibility for Use of the Services
You are responsible for your use of FortisVPN and for complying with laws applicable to your conduct.
You are also responsible for maintaining appropriate security for your devices, accounts, credentials, and software.
FortisVPN does not provide legal advice regarding whether VPN use or particular internet activity is lawful in a specific jurisdiction.
Laws concerning VPN services may vary between countries and may change over time.
33. Indemnification
To the extent permitted by applicable law, if you use FortisVPN for commercial purposes or engage in intentional unlawful or abusive conduct, you agree to indemnify and hold harmless EACT Technologies OÜ from third-party claims, liabilities, damages, and reasonable costs arising directly from your material violation of these Terms, your intentional unlawful use of the Services, or your infringement of a third party's rights.
This provision does not apply where prohibited by applicable consumer law and does not require consumers to indemnify FortisVPN for matters for which FortisVPN is legally responsible.
34. Governing Law
These Terms and the contractual relationship between you and EACT Technologies OÜ are governed by the laws of Estonia, without regard to conflict-of-law principles.
However, if you are a consumer residing in the European Union, European Economic Area, United Kingdom, or another jurisdiction whose mandatory consumer laws provide protections that cannot contractually be waived, this choice of law does not deprive you of those mandatory protections.
35. Dispute Resolution and Jurisdiction
We encourage users to contact us first if a dispute arises so that we can attempt to resolve the matter informally.

Subject to mandatory consumer law, disputes arising from these Terms or the Services may be submitted to the competent courts of Estonia.
If you are a consumer and applicable law grants you the right to bring proceedings in the courts of your country of residence or another jurisdiction, nothing in these Terms removes that right.
Nothing in this section prevents either party from seeking urgent or interim relief where permitted by law.
36. Consumer Rights
Nothing in these Terms is intended to exclude, restrict, or waive rights that consumers cannot lawfully waive.
Depending on where you live, mandatory consumer-protection laws may provide additional rights concerning digital services, subscription renewals, cancellation, refunds, conformity of digital content, warranties, unfair contractual terms, and dispute resolution.
Where these Terms conflict with a mandatory consumer right, the mandatory legal requirement will prevail to the extent of the conflict.
37. Changes to These Terms
We may update these Terms when necessary to reflect changes to the Services, new features, security requirements, legal or regulatory developments, changes to our business model, or other legitimate operational requirements.
When we update these Terms, we will revise the "Last Updated" date.
Where a change materially affects existing users' contractual rights, we will provide reasonable advance notice where required by applicable law.
If applicable law requires consent to a particular change, we will obtain that consent.
38. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where legally permissible.
The remaining provisions will continue in effect.
39. No Waiver
If FortisVPN does not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.
A waiver is effective only where made in accordance with applicable law.
40. Assignment
You may not transfer your contractual rights or obligations under these Terms to another person without our consent where such restriction is permitted by applicable law.
EACT Technologies OÜ may transfer its rights or obligations in connection with a merger, acquisition, corporate restructuring, sale of the FortisVPN business, or similar transaction, provided that doing so does not unlawfully reduce mandatory consumer protections.
41. Entire Agreement
These Terms, together with the policies and terms expressly incorporated into them, including the FortisVPN Privacy Policy and Refund Policy, constitute the agreement governing your use of the Services.
Additional terms may apply to particular promotions, features, payment methods, resellers, or application stores where disclosed.
